Introduction to Islamic Provision in Constitution of 1956
Pakistan is an ideological State because it was achieved in the name of Islam. After its establishment, efforts for making Pakistan to be an Islamic republic took momentum and due to the opposition of Western educated intellectual elites, this issue also clipped the growth of an accepted and viable Islamic Constitution. At last after 9 years of hard labour an equally authentic and accepted constitution was framed. Objective Resolution was include in the Preamble of the first Constitution of Pakistan and declared an Islamic Republic.
Islamic Provisions of the 1956 Constitution
Following are the Islamic Provisions of 1956 Constitution of Pakistan.
Objective Resolution – A Preamble
The Objective Resolution was included in the Preamble of the constitution, which starts with the name of Allah, the Merciful. It declared that Pakistan would he a democratic State, Every Muslim should order his life according Quran and Suunah.
Islamic Provisions
Islamic provisions were made part of the Directive Principles of State Policy. According to these principles the state was to endeavor:
- To provide facilities to the Muslims to enable them to spend life under rules the Holy Quran and Sunnah
- To secure the proper organization of Zakat and Auqaf
Pakistan will be an Islamic Republic
In this constitution of Pakistan the state of Pakistan was declared an Islamic State to be known as Islamic Republic of Pakistan. However, Islam was not made the state religion of Pakistan.
Head of State will be a Muslim
The Head of State was to be a Muslim. However, in case of the vacation of the office of the President due to foreign visit or his inability to discharge his duties, the Speaker of National Assembly would have to do his work who could be non-Muslim.
No un-Islamic Law
No law shall be enforced which would be against the rules of Holy Quran and Sunnah.
Establishment of Commission for Islamic Recommendations
Within one year President will employ a commission, the commission would verify the existing laws with Quran and Sunnah and give recommendations if necessary. National and Provincial Assemblies were also directed to check the legislative operations with Islamic Laws.
Abolition of Riba
Riba would be abolished as early as possible. The state would be responsible for socio-economic well-being of the people.
Friendly Relations with Muslim States
Pakistan should built healthy relations with other Muslims countries.
