Jurisprudence and Psychology
Psychology defined as “the study of human mind”. It deals with the mechanism of mind, how it is agitated and influenced, and what are the good and bad minds?
In modern society, most of the problems are solved by applying the rules of psychology. Everything happened in questioned under psychology, whether something good or bad it is initiated from mind. Similarly the public opinion is made and changed is due by convicting the mind of people and by contesting Tort crime and breach of jurisprudence. Similarly with society as in the study of criminal jurisprudence, there is a great scope for the study of psychological principles. In order to understand the criminal mind behind the crime, the questions as to:
- How does a criminal mind work?
- Why a particular crime committed in a particular society.
(Tort crime and the question are close to the section of criminology the study of criminal mind).
Every law relates to society and has to be applied on society. It is acceptable, if it is acceptable to human mind. Psychology is compulsory for a jurisprudence to study the minds of people of a society, necessary for legislation.
Tort crime and breach of contract are factor affirming the commission of a crime or offence. To declare something bad or good remains in conflict, between Individual and society. What is good for one may be bad for others, or what is good for one time with one nation may not be good for some nation at other time. The rules of positive morality being based on public opinion of a particular society necessarily vary from place to place and from time to time. Also ill man of not a human conduct, positive ethics is not dependent upon the voluntary conduct of good men but stands in need of concise rules or laws.
For this purpose, we have ethical jurisprudence, which examines the human conduct and made the law in accordance with human behavior. It suggests what the law ought to be by proposing changes requested in the existing law to being it in accordance with the requirements of public conscience.
